GENERAL CONDITIONS OF SALE AND USE

These general conditions of sale are available at any time and systematically brought to the attention of each customer/user in order to enable him to place an order. Thus, the fact of placing an order and ticking the box "I accept the general conditions of sale" during the payment process implies the full and unreserved acceptance of the customer to these general conditions of sale.

 

ARTICLE 1 –  CONCEPT

Privacy Escape is a life-size escape game concept owned by AGEN SECRET. These general terms and conditions of sale are applicable to any contract for the provision of a gaming room concluded between (1) any company of the AGEN SECRET group (company belonging to the group, company linked to AGEN SECRET by a franchise contract / license brand / ...) hereinafter PRIVACY ESCAPE and (2) the users of the room, which will be named USERS; thereafter; whether they have booked personally or whether they are part of the team of the person who made the reservation, hereinafter referred to as THE BUYER. These conditions also apply whatever the means of reservation, whether it is made via the AGEN SECRET website, hereinafter called WEBSITE or with the staff of the various places of operation of the PRIVACY ESCAPE brand. The game space made available to players is called "ROOM" and the provision contract CONTRACT;.The game portion for which the BUYER reserves and pays on the WEBSITE is called SESSION.
AGEN SECRET acknowledges the right to modify or have modified all or part of these general conditions of sale as well as the content of its WEBSITE (http://privacy-escape.com/), this at its sole discretion, at any time and without notice.
The general conditions of sale of AGEN SECRET are available on the WEBSITE and can be consulted freely on request from the reception staff of PRIVACY ESCAPE.

 

ARTICLE 2 – PROVISION AND USE OF THE ROOM

According to the very principle of the game, PRIVACY ESCAPE grants USERS the right to occupy the ROOM for a maximum duration of 60 (sixty) minutes. The occupation of the ROOM has the one and only goal  to participate in a game organized by PRIVACY ESCAPE, which must be carried out in teams of 2 to 7 people maximum.
The USERS accept that the duration of presence in the ROOM is 60 minutes maximum, this whether they have managed to find all the clues and solve all the puzzles or not. This point relates to the very principle of the game. At the same time, the USERS accept that the game stops before the end of the 60 minutes, in particular if they have managed to find all the clues and solve all the puzzles in less than 60 minutes; without this being subject to any price adjustment or compensation.
Admission to the ROOM is only possible upon presentation of the reservation confirmation email (sent shortly after the payment process to the BUYER) and upon presentation of an identity document from the latter.
Minor USERS under the age of 15  must be accompanied by an adult. Minor USERS over the age of 15 do not necessarily have to be accompanied by an adult. In case of doubt about the age of a USER, PRIVACY ESCAPE reserves the right to ask for proof of identity.
USERS are required to maintain the ROOM and all of its equipment (non-restrictive list: decorations, furnishings, etc.) in good condition and to use it in accordance with the authorized use. Therefore, the USER acknowledges in the CONTRACT that any damage intentional or caused by unauthorized manipulation of the room and its equipment will be subject to re-invoicing.
In addition, the USER is required to use the ROOM and its equipment in such a way as not to cause or risk causing any damage to other USERS, to the premises and equipment of PRIVACY ESCAPE.
Throughout his presence within the premises of PRIVACY ESCAPE, the USER undertakes to behave in a respectable manner, to comply with the rules and to cooperate with the staff of PRIVACY ESCAPE. As such, PRIVACY ESCAPE does not tolerate any form of violence, whether verbal or physical, in the form of harassment or intimidation towards its employees and thus reserves the right to refuse access to the premises to any person whose behavior would be similar to the elements mentioned above.  PRIVACY ESCAPE also reserves the right to refuse access to anyone under the influence of alcohol or drugs, as a security measure for said person and his entourage. For all the conditions mentioned above, the prohibition of access does not entitle you to any compensation or reimbursement.
Due to the nature of the game, no recordings can be made in the ROOM. Thus, the use of video and/or audio recording devices (this includes in particular and without limitation: mobile phones, cameras, Go Pro) is strictly prohibited. Any use of this type of device may cause the game to stop completely for the whole team.
PRIVACY ESCAPE expects its USERS not to disclose game details directly and/or indirectly. Any partial and total disclosure would violate the commercial interests of PRIVACY ESCAPE.

 

ARTICLE 3 – PRICE

The prices charged by PRIVACY ESCAPE are indicated on the WEBSITE in the Page price and are also displayed at the reception of the premises of PRIVACY ESCAPE.

The prices indicated by PRIVACY ESCAPE are in euros, all taxes included, taking into account the VAT applicable on the day of the order, any change in the rate may be passed on to the price of the services.

PRIVACY ESCAPE reserves the right to modify the prices appearing on its website at any time.

In all cases, the service will be invoiced on the basis of the rates in force and mentioned on the site at the time of booking.
If only two USERS wish to participate in the game, a SESSION for three USERS must nevertheless be reserved.
Any other service will give rise to additional invoicing.
PRIVACY ESCAPE reserves the right to modify its prices at any time. Any BUYER will pay the amount relating to the rate in force at the time of their reservation.

PRIVACY ESCAPE accepts different types of payments depending on the city and establishment in question.

ARTICLE 4 – RESERVATION

The provision of a ROOM is subject to reservation and prior payment. This is done by the BUYER on the PRIVACY ESCAPE WEBSITE.
All reservations are made from the WEBSITE and according to the availability displayed on it. The reservation is firm and final only after receipt of the reservation confirmation email, which is sent to the BUYER at the end of the payment process.
In certain exceptional cases, the staff of PRIVACY ESCAPE can make the reservation on behalf of the BUYER if the latter cannot make the reservation himself on the WEBSITE. In these specific cases, the BUYER unreservedly accepts that this type of reservation entails no liability on the part of PRIVACY ESCAPE or its staff, the staff then only acting as an entry operator according to the instructions given by the BUYER. The BUYER therefore waives all recourse due to misuse, breach of confidentiality of his data or fraudulent use of his account.
The WEBSITE is available in French and English. However, in the event of a dispute, only the French version of the WEBSITE and the general conditions of sale may be opposed to PRIVACY ESCAPE.
A reservation cannot be transferred or resold for commercial purposes. If a reservation is transferred or resold in violation of this article, the holder thereof will be denied access.
If USERS are late for a reserved SESSION, PRIVACY ESCAPE may decide whether or not to start the game. In all cases, the ROOM must be vacated at the time provided for in the initial reservation. PRIVACY ESCAPE reserves the right to refuse access to USERS whose delay amounts to 15 minutes or more. The schedules will be systematically reminded in the confirmation emails sent by PRIVACY ESCAPE.
If fewer USERS show up to participate in the game SESSION than initially planned when booking, the BUYER and/or the USERS cannot claim reimbursement of the difference in price.
If more USERS show up to take part in the game SESSION than initially planned when booking, the price difference must be paid before taking part in the game, within the limit of 7 USERS authorized per ROOM.
PRIVACY ESCAPE reserves the right to refuse any reservation to a BUYER who has not paid for all the services that have been invoiced to him.

ARTICLE 5 – RIGHT OF WITHDRAWAL

In accordance with Article 121-21-8 of the Consumer Code, the right of withdrawal cannot be exercised for contracts for the provision of accommodation services, other than residential accommodation, goods transport services, location of cars, catering or leisure activities that must be provided on a specific date or period. Therefore, no reservation can be canceled or refunded except in the context of a cancellation solely because of PRIVACY ESCAPE. In the latter case, the amount of the initial reservation will be refunded.

• A cancellation fee of €60 will be applied for cancellations made less than 24 hours in advance or in the event of a no-show.

• A cancellation fee of €20 will be applied for cancellations made less than 3 days in advance.

• A €5 cancellation fee will apply for cancellations made 3 days or more in advance

ARTICLE 6 – PERSONAL DATA

The BUYER is responsible for the accuracy of the information entered on the online booking form on the WEBSITE.
The BUYER agrees to receive from PRIVACY ESCAPE information and commercial offers on his email address or on his mobile phone by clicking on the authorization box on the WEBSITE.
The BUYER and/or the USER who enters his telephone details on the PRIVACY ESCAPE WEBSITE already agree to be contacted by PRIVACY ESCAPE by telephone or SMS.
The BUYER providing the contact details of other players / USERS (first and last names, telephone numbers, email addresses) authorizes PRIVACY ESCAPE to send information and commercial offers to them.
PRIVACY ESCAPE undertakes not to transmit the personal data of its USERS to a company outside the AGEN SECRET group, except at the request of an authority empowered by law and within the framework of the legal provisions in force.
 

ARTICLE 7 – SECURITY

The USER undertakes to respect all the security measures given to him, whether contractual, displayed on site or given orally by the staff of PRIVACY ESCAPE.
It is formally and strictly forbidden to smoke inside the site.
Each USER undertakes to read and respect the safety and fire protection instructions, as well as the emergency exits. These are clearly identified in the premises of PRIVACY ESCAPE  As such, it is strictly forbidden to interfere with the emergency exits, which must remain clear in all circumstances. The USER may use the emergency exits if, and only if, the situation requires the evacuation of the premises (fire for example). Any abuse and/or untimely opening of these exits by one or more USER(S) will lead to the re-invoicing of the costs incurred by this abuse.
The USER is aware that it is absolutely forbidden to bring into the premises and into the ROOM objects considered as (1) physical dangers (explosive, flammable, oxidizing, pressurized or liquefied gas, corrosive), (2 ) hazardous to health (toxic, corrosive to the skin, irritant/sensitizer, carcinogenic/teratogenic) and (3) hazardous to the aquatic environment.

 

ARTICLE 8 – PHOTOS AND CAMERAS

Photos of each team of USERS may be taken before or after the game session. These photos may be used by PRIVACY ESCAPE to feed its WEBSITE or its digital ecosystem (Examples without restriction, Facebook, Twitter, Instagram etc. ).
PRIVACY ESCAPE cannot be held responsible for the use that will be made of the photos by the USERS and / or the BUYER.
Each ROOM has a video surveillance and listening device allowing PRIVACY ESCAPE staff to monitor the game session and help USERS if necessary. This device contributes only to the game and does not record the game SESSIONS of the USERS.

 

ARTICLE 9 – COMPETENT COURTS

These terms and conditions and any contract entered into incorporating these terms and conditions are governed by French law and all disputes are subject to the exclusive jurisdiction of the French courts.
